IMPORTANT: PLEASE READ THIS ENTIRE DOCUMENT CAREFULLY BEFORE PARTICIPATING IN ANY EVENT. THIS IS A LEGALLY BINDING AGREEMENT THAT AFFECTS YOUR LEGAL RIGHTS.
By participating in any event organized through or in connection with Landbound ("Event"), you acknowledge that you have read, understand, and agree to be bound by the terms of this Event Participation Waiver ("Waiver").
1. Acknowledgment of Risks
I understand and acknowledge that outdoor recreational activities, including but not limited to hiking, camping, climbing, backpacking, kayaking, canoeing, rafting, skiing, snowboarding, mountain biking, trail running, swimming, and other adventure activities ("Activities"), are inherently dangerous and involve significant risks that cannot be eliminated regardless of the care taken to avoid them.
I UNDERSTAND THAT THESE ACTIVITIES CAN RESULT IN SERIOUS INJURY, PERMANENT DISABILITY, PARALYSIS, AND DEATH.
The risks and dangers of participating in Activities include, but are not limited to:
- Falling, slipping, or tripping on uneven, wet, icy, rocky, or unstable terrain
- Collision with natural objects (trees, rocks, cliffs) or man-made objects (buildings, vehicles, equipment)
- Drowning, near-drowning, and other water-related incidents
- Exposure to extreme weather conditions including heat, cold, rain, snow, lightning, wind, and sun
- Hypothermia, hyperthermia, heat stroke, heat exhaustion, dehydration, and sunburn
- Altitude sickness, pulmonary edema, and cerebral edema
- Encounters with wild animals, venomous snakes, insects, spiders, and hazardous plants
- Avalanches, rockfalls, mudslides, flash floods, and other natural disasters
- Equipment failure, malfunction, or improper use
- Getting lost, stranded, or separated from the group
- Vehicular accidents during travel to, from, or during Activities
- Actions, omissions, negligence, or recklessness of other participants, event organizers, guides, or third parties
- My own physical condition, fitness level, and judgment
- Lack of immediate access to emergency medical care or evacuation services
- Communication failures in remote areas
- Unknown or unmarked hazards on trails, routes, or activity locations
- Errors in trail information, maps, or route descriptions
- Trespassing on private property or restricted areas
I understand that the above list is not exhaustive and that other risks, known and unknown, inherent and external, may also be present.
2. Voluntary Participation
I acknowledge and agree that:
- My participation in any Event is entirely voluntary
- I have had sufficient opportunity to read this Waiver and ask questions about it
- I freely choose to participate in the Event despite the risks described above
- I am not under any duress or pressure to participate
- I am free to withdraw from participation at any time before or during the Event
- I am responsible for assessing whether my skills, experience, and fitness level are adequate for the Event
- I have disclosed any relevant medical conditions or limitations to the event organizer
I FREELY AND VOLUNTARILY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, ASSOCIATED WITH MY PARTICIPATION IN THE EVENT, EVEN IF SUCH RISKS ARISE FROM THE NEGLIGENCE OF THE RELEASED PARTIES (DEFINED BELOW) OR OTHERS.
3. Release and Waiver of Claims
In consideration of being permitted to participate in the Event, I hereby agree as follows:
Release. I, for myself and on behalf of my heirs, executors, administrators, personal representatives, assigns, and estate, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Stramon, LLC d/b/a Landbound, its parent companies, subsidiaries, and affiliates, and each of their respective officers, directors, members, managers, employees, agents, contractors, volunteers, representatives, successors, and assigns, as well as all event organizers, hosts, sponsors, venue owners, property owners, guides, instructors, and other participants (collectively, the "Released Parties") from any and all liability, claims, demands, actions, causes of action, suits, costs, expenses, and damages (including attorneys' fees) of any kind or nature whatsoever, whether known or unknown, arising out of or relating to my participation in the Event.
Scope of Release. This release applies to, but is not limited to, claims for:
- Personal injury, bodily harm, illness, disease, and death
- Property damage, theft, and loss
- Emotional distress and mental anguish
- Negligence (including gross negligence to the maximum extent permitted by law)
- Breach of contract, warranty, or duty
- Any other loss, cost, or expense
Waiver of Claims. I expressly waive any and all claims, known or unknown, that I may have against the Released Parties arising from my participation in the Event. I understand and agree that this waiver includes claims arising from the negligence of the Released Parties.
Covenant Not to Sue. I agree that I will not bring any lawsuit, claim, or legal action against any of the Released Parties for any injury, damage, or loss arising from my participation in the Event.
Exception. This release does not apply to claims arising from intentional misconduct or fraud by the Released Parties.
4. Medical Acknowledgment & Authorization
I represent and warrant that:
- I am in good physical and mental health and capable of participating in the Event
- I have no medical or physical conditions that would prevent my safe participation, or I have obtained medical clearance from a qualified healthcare provider
- I am not under the influence of alcohol or drugs that would impair my ability to safely participate
- I will inform the event organizer of any medical conditions, allergies, or medications that may be relevant to my participation or emergency treatment
- I am solely responsible for obtaining my own health and accident insurance coverage
Emergency Medical Authorization. In the event of an emergency, I authorize the Released Parties to arrange for emergency medical treatment, evacuation, or transportation at my sole cost and expense. I understand that the Released Parties are not obligated to provide such assistance but may do so at their discretion.
I agree to hold the Released Parties harmless for any decisions made or actions taken in good faith regarding my medical care in an emergency situation.
5. Photo & Media Release
I understand that photographs, videos, and other recordings may be taken during the Event by event organizers, other participants, or representatives of Landbound.
I hereby grant to Stramon, LLC d/b/a Landbound and the event organizers a perpetual, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, adapt, publish, display, and distribute any photographs, videos, or recordings of me taken during the Event for any lawful purpose, including but not limited to:
- Promotional materials and marketing
- Social media posts and website content
- Advertising and publicity
- Event documentation and archives
I waive any right to inspect or approve the finished product or any materials that may be used, and I waive any claim for compensation for such use.
I release the Released Parties from any claims arising from the use of my image, likeness, voice, or other personal attributes in such materials.
6. Indemnification
I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) that may be brought against them by me, my family members, my estate, or any third party, arising out of or in any way related to my participation in the Event, including but not limited to:
- Any injury, damage, or loss suffered by me
- Any injury, damage, or loss caused to others by me
- Any violation of this Waiver by me
- Any misrepresentation made by me
- Any violation of applicable law by me
7. Additional Terms
Compliance with Rules. I agree to follow all rules, instructions, and guidelines provided by event organizers and to use all safety equipment as directed. I understand that my failure to comply may result in my removal from the Event without refund.
Cancellation. I understand that Events may be cancelled or modified at any time due to weather, safety concerns, or other factors beyond the control of the organizers.
Personal Property. I am solely responsible for my personal property and belongings. The Released Parties are not responsible for any lost, stolen, or damaged personal property.
Leave No Trace. I agree to follow Leave No Trace principles and all applicable environmental regulations during the Event.
8. Governing Law & Severability
Governing Law. This Waiver shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action arising out of this Waiver shall be brought exclusively in the state or federal courts located in Delaware.
Severability. If any provision of this Waiver is found to be invalid, illegal, or unenforceable, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement. This Waiver, together with the Landbound Terms of Service and Privacy Policy, constitutes the entire agreement between the parties regarding my participation in the Event and supersedes all prior agreements and understandings.
Binding Effect. This Waiver shall be binding upon my heirs, executors, administrators, personal representatives, assigns, and estate.
9. Acknowledgment & Agreement
BY PARTICIPATING IN ANY EVENT, I ACKNOWLEDGE AND AGREE THAT:
- I have carefully read and fully understand this entire Waiver
- I understand that I am giving up substantial legal rights, including my right to sue the Released Parties
- I am signing this Waiver freely and voluntarily, without any inducement
- I am at least 18 years of age and legally competent to enter into this binding agreement
- I understand that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Delaware
- My electronic acceptance or participation in the Event constitutes my signature and agreement to all terms of this Waiver
If you do not agree to the terms of this Waiver, you may not participate in any Event.
